Jurisdiction, Governing Law and Arbitration
Noranda Income Fund makes no representation that the Materials are appropriate or available for use in any particular location. Those who choose to access this Site do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. These Terms and Conditions and your use of this Site shall be construed in accordance with and be governed by the laws in force in the Province of Ontario and the federal laws of Canada applicable therein, without reference to any choice of law or conflict of law principles. Any claim or cause of action that you may have with respect to this Site or our acts, omissions or services must be commenced within one (1) year after the claim or cause of action arises.

If any provision of these Terms and Conditions shall be deemed unlawful by a court of law, then the impugned provision shall be deemed severed and shall not affect the validity and enforceability of any remaining provisions. Noranda Income Fund's failure to insist upon or enforce strict performance of any provision of the Terms and Conditions shall not be construed as a waiver of any provision or right. These Terms and Conditions comprise the entire agreement between you and Noranda Income Fund and supersede all prior agreements between the parties regarding the subject matter contained herein.
